  1. Scope of application

1.1 For the business relationship between Dangerous9Straps (hereinafter “Seller”) and the customer (hereinafter “Customer”) the following General Terms and Conditions shall apply exclusively in the version valid at the time of the order.

1.2 A consumer in the sense of these GTC is any natural person who enters into a legal transaction for a purpose which can predominantly neither be attributed to his commercial nor to his independent professional activity (Article §13 German Law -§ 13 BGB).

1.3 Deviating conditions of the customer are not recognized unless the seller expressly agrees to their validity.

  1. Offers and service descriptions

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Service descriptions in catalogues and on the websites of the seller do not hold an assurance or guarantee.

2.2 All offers are based on availability, unless otherwise stated in the products. In all other respects, errors are reserved.

 2.3 Notice – Product presentation:

Color is displayed differently depending on what monitor and graphics card you use.  We do our best to photograph our products with the best possible color fidelity.  Additionally, we also calibrate our monitors to ensure accurate color representation.  However, ultimately we cannot guarantee the product you receive will be the exact color you see on your monitor.  If you are concerned or have a preference about a particular hue or tint of a strap, please contact us.

2.4 Notice – Product specific attributes 

Appearance of leather: Light blemishes, scars, imperfections and color deviations are natural and demonstrate that the leather is actually genuine and unique. It does not diminish the quality. Color variations are dependent on the tanning process. Organic materials can vary in their appearance even though they undergo the same tanning process. There is no guarantee of standardized color accuracy and replication, except for black.

  1. Order process and completion of contract

3.1 The customer can select products from the seller’s range without obligation and collect them in a so-called shopping basket by clicking on the[add to shopping basket] button. Within the shopping cart the product selection can be changed, e.g. deleted. The customer can then proceed to the completion of the order process within the shopping basket using the button[Proceed to checkout].

3.2 The customer submits a binding application for the purchase of the goods in the shopping basket via the button[Payable order]. Before sending the order, the customer can change and view the data at any time and return to the shopping basket or cancel the order process as a whole using the browser function “back”. Required fields are marked with an asterisk (*).

3.3 The seller then sends the customer an automatic confirmation of receipt by e-mail, in which the customer’s order is listed again and which the customer can print out using the “Print” function (order confirmation). The automatic acknowledgement of receipt merely documents that the customer’s order has been received by the seller and does not constitute acceptance of the request. The sales contract is only concluded when the seller has dispatched the ordered product within 14 days to the customer, handed it over or confirmed the production of the ordered goods to the customer within 2 days with a second e-mail, express order confirmation or sending the invoice.

3.4 If payment is not received by the Seller, the Seller shall withdraw from the contract with the consequence that the order shall lapse and the Seller shall not be obliged to deliver. The order is then completed for the buyer and seller without further consequences.

  1. Availability of goods

Delivery shall take place upon payment of invoice, order fulfillment/custom production and dispatch of goods.

5.3 If the ordered product is not available because Dagnerous9straps is not supplied with this product by his supplier through no fault of his own, Dangerous9straps may withdraw from the contract. In this case we will immediately inform the customer and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or the customer does not wish to receive a comparable product, the seller will reimburse the customer immediately.

  1. Prices and shipping costs

5.1 All prices quoted on the Seller’s website are inclusive of the applicable statutory value-added tax for European customers. Value added tax does not apply to customers residing outside the EU.

5.2 In addition to the stated prices, the Seller (Dangerous9straps/D9straps) shall charge shipping costs for the delivery. Deliveries are made always at the risk and the expense of the customer. Shipping costs will be clearly communicated to the buyer in the course of the order process.

5.3 Possible import taxes for international shipments are the responsibility of the customer.

5.4 Dagnerous9straps is not responsible for delays occurring during shipping. The specified delivery time is always an estimate and thus non-binding. Partial deliveries are allowed.
Note: If our delivery is delayed due to changes in the order or because we are out of the desired material, we reserve the right to make it right. A reasonable grace period of 4-5 weeks applies. Delivery times will also be extended by disputes that arise with any of our suppliers that take part in the fulfilling of the order. This also entitles us to withdraw from the contract if the order cannot be fulfilled. There can be no claims to compensation for failure to comply with delivery times.

  1. Terms of payment

6.1 The customer can choose from the available payment methods during and before completion of the order process. Customers are informed about the available means of payment. Payment must be made in advance without deduction.

6.2 If third-party providers are commissioned with the payment processing, e.g. Paypal, their general terms and conditions apply.

6.3 We accept Paypal payments for all transactions.

Europe wide sales possible via bank transfer – all bank fees are to the expense of the customer.

6.4. The customer can only exercise a right of retention if the claims result from the same contractual relationship. The customer is only entitled to a right of set-off if his counterclaims have been legally established or acknowledged by the seller.

7 Retention of title

The delivered goods remain the property of Dagnerous9straps until reception by the buyer.

8 Warranty for material defects and guarantee

8.1 The warranty is governed by statutory provisions.

8.2 A guarantee exists for the goods supplied by the Dangerous9straps. We will stand behind our workmanship and materials with a 6 month warranty. If for any reason your new watch strap fails under normal use and care due to a defect of either materials or workmanship, we will repair or replace the item. Customers are informed of the warranty conditions before initiating the order process.

Note: Our artisan products are made of organic leather that has not been subjected to elaborate tests. No guarantee is made for colour-fastness, light-fastness or waterproof. Please do not order from us if you don’t agree with our policy. 

8.3. Common sense/Normal use
Please apply common sense when using our products. Dangerous9straps are made using the finest natural Vege-Tanned leather and genuine skins available. They have a hand buffed finish, but they are not waterproof. As the service life of a strap depends on individual use, we can make no guarantee that the strap will last for a specific period of time. Repeated exposure to water, salt, soaps, solvents or any other harsh chemicals will damage the leather and/or the finish.  Do not expose these straps for an extended period of time to intense sunlight. Any natural leather or cloth will change it’s color over time, when left in the sun. Natural leather products will absorb moisture which in turn needs to air out. Don’t wear your strap 24 hours a day for lengthy times.  Do use a soft cloth to occasionally wipe over and polish your strap.  Do not use any wax or conditioner as it might change the appearance of the leather like darken the color, or interfere with the finish.

  1. Returns

Standard items like accessories and buckles can be returned to us. However, Dangerous9straps generally does not accept returns for custom straps, due to the fact that every strap from Dagnerous9straps is custom made to fit the buyer. Legal source for the return policy: § 312g BGB (German Law).

We do accept the return of a custom watch strap, if the watch strap you received is not the product you ordered, is defect or shows deficiencies. Please do not buy any watch straps if you disagree with our return policy! Complaints need to be in written form (email) and to be made within 14 days of reception. To exercise your right of withdrawal/revocation of contract, you must inform us in writing by either filling out the model withdrawal form or by giving us the equivalent information about your transaction details, i.e. product name, buyer name, purchase date, shipping address, etc.

If damage to the order occurred during shipping, the delivery company must confirm that the package was damaged during that process. Straps that have already been worn and/or flexed or willfully damaged by the customer are explicitly excluded. The customer is not entitled to change the order because of it, request a price reduction or request compensation.

Note: Do not return straps without contacting us as we will not accept them!

Once we receive a complaint we will process the action and offer a solution. We are entitled to repair the item or to provide a replacement. We will reimburse you if the fault lies with us in regard to custom orders or you want to return standard items. We will reimburse you, once we have received the goods back. Accepted claims can be shipped to the address of the return center that we will provide. It is important that you only ship to the location that we will provide to you. In general, the following rule applies: Products that were shipped to “the world” which means “countries outside of the European Union” can be returned to the USA. Customers that reside within the EU can send their accepted returns to Germany.

  1. Liability

10.1 The following exclusions and limitations of liability apply to Dangerous9traps liability for damages without prejudice to the other statutory conditions for claims.

Dangerous9straps is only liable for the foreseeable, contract-typical damage.

We shall not be liable for third party breach of obligations and negligence in the process of fulfilling the contract/and delivery of the order.

11 Storage of the contract text

11.1 The customer can print out the text of the contract before placing the order with the seller by using the print function of his browser in the last step of the order.

11.2 Dangerous9straps shall also send the Customer an order confirmation with all order data to the e-mail address provided by him. With the order confirmation the customer also receives a copy of the General Terms and Conditions together with instructions on revocation and the information on shipping costs as well as delivery and payment conditions. If you have registered in our shop, you can view your orders in your profile area. In addition, we store the contract text, but do not make it accessible on the Internet.

  1. Concluding provisions

12.1 Place of jurisdiction and place of performance is the registered office of the seller if the customer is a merchant, legal entity under public law or special fund under public law.

12.2 The contractual language is English.
